Copyright and DMCA policy
Lark & Clover is operated by Evershop Limited, a company registered in Hong Kong. We respect the intellectual property rights of others and expect our customers, partners and suppliers to do the same. We respond to valid notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512). This policy applies to larkandclover.com and any related sites we operate.
Reporting alleged copyright infringement
If you are a copyright owner, or authorised to act for one, and believe material on this site infringes your copyright, send a written notice to our designated Copyright Agent (below). To be effective under 17 U.S.C. § 512(c)(3) it must include: (1) a physical or electronic signature of a person authorised to act for the owner; (2) identification of the copyrighted work claimed to have been infringed; (3) identification of the material claimed to be infringing, with the full URL of every page or image; (4) your name, mailing address, telephone number and email address; (5) a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent or the law; and (6) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act on the owner's behalf. We also ask for documentary evidence of ownership (registration number or documented chain of title); it is not a statutory requirement but it materially speeds up review.
Counter-notification
If your material was removed and you believe that was a mistake or misidentification, you may send a counter-notification to the Copyright Agent containing the elements listed in 17 U.S.C. § 512(g)(3). We may restore the material within 10–14 business days of receiving a valid counter-notification unless the original notifier informs us that they have filed a court action.
Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, is liable for the damages (including costs and attorneys' fees) incurred by the alleged infringer, the copyright owner or the service provider as a result. Every notice we receive is logged and preserved.
Repeat infringers
Consistent with 17 U.S.C. § 512(i), we terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
